Why it is important that Academies get the very best HR Advice?

 

The move from being a maintained to an Academy School offers significant flexibilities in terms of Pay and Conditions of Service. A significant difference, however, is the loss of the ‘umbrella protection’ of the Local Authority, provided by Section 37 of the Education Act, 2002, and specifically, Section 37(5) which requires the costs of redundancy and severance payments to be met by the maintaining Local Authority unless there is good reason to charge the costs to the School’s budget.

 

An Academy does not have this protection offered by the Education Act so it is even more important that HR decisions are robust and defensible.
